Terms of Use

Last Updated: June 25, 2025

1. Acceptance of Terms

By downloading, installing, or using Foo ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Foo is developed and maintained by an individual developer based in Italy. These terms form the entire agreement between you and the developer regarding your use of the App.

2. License to Use

Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, revocable license to install and use Foo on Apple devices that you own or control, solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the App or any of its content
  • Reverse-engineer, decompile, or disassemble the App
  • Use the App for any commercial purpose without prior written consent
  • Transfer your license to another person

This license does not give you ownership of the App or its intellectual property. All rights not expressly granted here are reserved.

3. Free & Pro Features

Foo is available in two tiers:

  • Free — allows you to store up to 3 recipes and use basic pantry features at no cost, for as long as you like.
  • Pro — unlocks unlimited recipes, Smart Shopping Lists, Kitchen Stats, food waste tracking, and all future Pro features. Available as a monthly auto-renewing subscription or a one-time lifetime purchase.

Features available in each tier are subject to change. We will endeavor to notify users in advance of any meaningful changes to what is included in the free tier.

4. Subscriptions & Purchases

Billing by Apple. All payments — including Pro subscriptions and the lifetime purchase — are processed exclusively by Apple through the App Store. We do not handle, store, or have access to your payment information. Pricing is set in App Store Connect and displayed to you in your local currency before purchase.

Auto-renewal. The Pro monthly subscription is auto-renewing. Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the renewal date.

How to cancel. To cancel your subscription, go to iOS Settings → [Your Name] → Subscriptions → Foo and select "Cancel Subscription." Cancellation takes effect at the end of the current billing period; you will retain Pro access until then.

Refunds. We do not process refunds directly. All refund requests must be submitted to Apple through their standard refund process at reportaproblem.apple.com. Refunds are granted at Apple's sole discretion in accordance with their policies.

Price changes. Subscription prices may change. If the price of your subscription increases, Apple will notify you before the renewal. Continued use after the price change constitutes acceptance of the new price.

5. User Content

All content you create in Foo — including recipes, pantry entries, food logs, shopping lists, and photos — belongs to you. We make no claim of ownership over your data.

Since all data is stored locally on your device, you are responsible for backing it up. We cannot recover data that is lost due to device failure, accidental deletion, or app removal. iCloud Backup may include your Foo data if enabled in your device settings, subject to Apple's terms.

6. Prohibited Uses

You agree not to use Foo to:

  • Violate any applicable law or regulation
  • Attempt to circumvent or disable any feature, license check, or in-app purchase
  • Use the App in any way that could harm, disable, or impair it
  • Use automated tools to interact with the App

7. Disclaimer of Warranties

Foo is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, the developer expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or free of bugs or security vulnerabilities. Nutritional or food-related information displayed in the App is for organizational purposes only and should not be relied upon as medical or dietary advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of (or inability to use) the App.

In any case, our total liability to you for any claim arising from or relating to these Terms or your use of the App shall not exceed the amount you paid for the App or its features in the twelve months preceding the claim, or €10, whichever is greater.

9. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For significant changes, we may also notify you through the App. Your continued use of Foo after any changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict-of-law principles. As the developer is based in Italy and operates within the European Union, EU consumer protection regulations also apply where applicable.

Any disputes arising from these Terms or your use of Foo shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection laws in your country of residence provide otherwise.
